USA har i en spektakulær militæraktion anholdt Venezuelas diktator, den kommunistiske narkokartel-boss Nicolas Maduro og frue. Et eller andet havde været ventet længe, som en større hangarskibs-gruppe for nogle måneder siden blev parkeret ud for Venezuelas Kyst. “It gotta be somewhere” havde Trump sagt og tilføjet “It’s a big one!”. Aktionen har selvfølgelig delt vandene efter, hvad man mener om den amerikanske præsident Trump. Og, selvfølgelig, helt afkoblet fra principper man tidligere har forfægtet som David Strom skriver for Hot Air
Our adversaries and “allies” are appalled, of course, because Venezuela is supposedly a sovereign state. Not sure how anybody who supported Obama and Biden’s color revolutions and the military action in Libya could say any of that with a straight face, but then again, these people are shameless.
On the left, everybody from the hard communists to the soft communists is angry, as are Tucker Carlson and Candace Owens, of course. All are united by the belief that the United States is in the wrong no matter what.

FNs generalsekretær António Guterres var ligeledes oprørt og mente, som så mange andre på nettet, at “these developments constitute a dangerous precedent”. Det tog er for længst kørt, det hed ‘den liberale hegemoni’.
De juridiske og præcedens advarende argumenter gav juraprofessor Jonathan Turley nemlig ikke meget for: “Legally, Trump has the upper hand in this case”. Kritikerne “may want to review past cases, particularly the decision related to the Noriega prosecution after his capture by President George H.W. Bush in 1989.”
This operation will be justified as executing the criminal warrant and responding to an international drug cartel, a very similar legal framework to the one used against Noriega. There is precedent supporting that earlier operation, which will now be used to defend the actions in Venezuela.

Trump does not need congressional approval for this type of operation. Presidents, including Democratic presidents, have launched lethal attacks regularly against individuals. President Barack Obama killed an American citizen under this “kill list” policy. If Obama can vaporize an American citizen without even a criminal charge, Trump can capture a foreign citizen with a pending criminal indictment without prior congressional approval.
Ordinarily, the Vienna Convention on Consular Relations and other international agreements require the United States to notify the embassy of a foreign national arrested and held in the United States. Notice seems a tad superfluous in this case.
In his appeal, Noriega argued that his arrest violated international law under the head-of-state immunity doctrine. The district court rejected Noriega’s head-of-state immunity claim because the United States government never recognized Noriega as Panama’s legitimate ruler — an argument that will be made in the Maduro prosecution.
The United States for the Eleventh Circuit also rejected the immunity claim.
Noriega also argued that his capture violated the Treaty Providing for the Extradition of Criminals, May 25, 1904, United States of America-Republic of Panama, 34 Stat. 2851 (“U.S.-Panama Extradition Treaty”). The Supreme Court’s decision in United States v. Alvarez-Machain, 504 U.S. 655 (1992), however, was found to bar this argument.

Så, fik vi at se hvad USAs nye sikkerhedsdoktrin indebærer. I dag Venezuela. I morgen måske Grønland. Trump tager og stjæler hvad han vil med magt. Derfor så afgørende at Danmark og EU siger klart fra.

“Venezuela is bombed. The European Union must condemn this attack immediately” skrev The Left in the European Parliament “We stand with the people of Venezuela against military aggression”. Første kommentar viste venezuelanere der festede i gaderne. “Bombing a sovereign nation and kidnapping the President is the behaviour of a cowboy state” skrev den engelske labour formand Jeremy Corbyn og fortsatte “The United States’ attack on Venezuela is illegal — and it is utterly shameful that the UK government refuses to condemn this reckless act of war.”
Går man lidt tilbage i tiden var tonen anderledes. “Trump is not only praising far right leaders like Putin and Orban, he’s praising communist dictator’s like Xi Jinping for ruling ‘with an iron fist’ and most recently Maduro of Venezuela” fortalte Professor Ruth Ben-Ghiat til MSNBC i ‘24 “It’s not even about right or left, what Trump cares about is that these leaders have deprived their people their freedom and that they have maneuverede themselves into absolute power”. Imens hun demonstrerede sine tankelæsningsevner kunne man læse en tekst nederst i billedet, der sagde “Fears grows that election deniers would block Harris win” – minder, minder… En anden sagde til stationen
Maduro, who is what Donald Trump wants to be. He wants to be the kind of guy that it doesn’t matter if you win or lose, you get to stay in power. and Maduro was staying in power by blowing up the rule of law in Venezuela and coopting the military for his political purposes, that is what Donald Trump is capable of and that is not America
Barack Obama kaldte i 2015 Venezuela for “national security threat” og Joe Biden fordømte i 2020 Maduros “violent takeover of the Venezuelan National Assembly” og betegnede Maduro som en “dictator”.

“I saw friends eat dogs to survive. I don’t understand how they DEFEND a dictator who has the biggest torture center in Latin America” sagde en ung mand. Og ‘they are eating the lions, they are eating the giraffes’ i den lokale zoo.
