Trump tiltalt, tredje forsøg på at stoppe ham

Er jeg den eneste, der har en fornemmelse af at alting Trump handler om Rusland og Ukraine? Trump er blevet sigtet for at have haft usømmelig omgang med hemmeligtstemplede papirer. Den sigtelse falder samme dag, som Republikanerne i Kongressen, efter lang tids tovtrækkeri med FBI, får indsigt i et dokumentet, der påstår, at præsident Biden modtog 5 mio dollars som bestikkelse, fra det ukrainske energiselskab Ukraine, hvor hans søn var bestyrelsesmedlem. Ikke overraskende skulle bestikkelsen være sket da Biden i sin tid som vicepræsident, krævede en statsanklager fyret, angiveligt fordi han efterforskede Burismas ejers korruption.

Som kandidat Robert F Kennedy forklarede, så var en del af Den Nye Verdensordens aftaler at Soviet/Rusland trak sig ud af østblokken og tillod Tysklands genforening mod at NATO ikke ville bevæge sig “an inch” østpå (bortset altså fra DDR). Men Mika Brezinskis far formulerede i slutningen af 90erne en politik, der nu havde som mål at inddæmme Rusland og i sidste ende knuse det ved at dræne det for ressourcer eventuelt gennem krig. Trump var en trussel mod denne forståelse.

Som  Mearsheimer siger lovede man, efter Polen og lignende landes optagelse i NATO, også medlemskab til Georgien og Ukraine på NATO mødet i Bukarest i 2008. Efterfølgende gik Rusland i krig i Sydossetien fordi de fandt Georgiens opførsel utålelig og smadrede landet så det ikke kunne være af værdi for NATO. Det samme stillede de Ukraine i udsigt. Men USA pressede alligevel på og nu drænes Rusland i en krig til amerikanernes moro mens Ukraines smadres til Ruslands tilfredshed. Imens sidder vi alle med truslen om en atomkrig for højere skatter.

Trumps præsidentskab var en krigsmoratorium, der udfordrede the Interagency Consensus. Derfor forsøgte man at undergrave hans kandidatur med spionagen mod hans organisation i form af Operation Crossfire Hurricane. Derpå lancerede man Mueller-efterforskningen, der skulle kæde ham sammen med ‘russerne’ i angiveligt at have underløbet den amerikanske valghandling. Derpå forsøgte man at rejse en Rigsretssag imod ham, fordi han talte med Ukrainske Zelinski om våbenhjælp og Bidens korruption. Så arrangerede man kaoset 6. januar og forsøgte at rejse endnu en Rigsret for inflammatorisk retorik.

Biden blev præsident fordi efterretningsvæsenet, the Interagency Consensus, censurerede historien om Bidens korruption. Nu har de deres krig i Ukraine.

One of the open questions will be the other part of Smith’s mandate. He was asked to look into criminal charges related to both the Jan. 6, 2021, riot in the Capitol and the classified documents which Trump allegedly held at his Mar-a-Lago home. Smith made fast work of the Mar-a-Lago part, but there is no indication of what is occurring on the other matter.

If Smith has found that there is no basis for criminal charges over Trump’s role on Jan. 6, it would be the final rejection of claims by the House of Representatives’ Jan. 6th Committee and by a host of politicians and pundits. The question is whether Smith will be as quick to resolve that question as he has been in alleging the crimes at Mar-a-Lago.

Regarding Mar-a-Lago, the reported inclusion of a charge under the Espionage Act is a bit surprising, given the novel legal issues surrounding the handling of such documents. However, the inclusion of false-statement and obstruction charges is what many of us have predicted all along. These are the favorite charges of federal prosecutors; they are easier to prove and can be presented as stand-alone offenses.

Those charges will become even more challenging for Trump if, as rumored, Smith has secured the cooperation of individuals within the Trump team. Earlier, Smith reportedly compelled the appearance of Trump lawyers before the grand jury. There is also a leak suggesting that Smith has an audiotape of Trump referring to his possession of a classified document on Iran — and acknowledging that he could not show or discuss the contents.

For two years, I have said that the Mar-a-Lago charges — particularly obstruction — represent the greatest threat to Donald Trump. It remains baffling why Trump forced this issue over these documents rather than just give them all back. (He could still have gotten access to them from the National Archives.) He knew that he was unlikely to receive much deference from the DOJ. Yet, he allowed this collateral controversy to consume his campaign.

Once again, however, the campaign is all about Trump. Moreover, there could be a method to the madness, as Trump seeks to try this case before the public.

The Justice Department has done tremendous damage to itself — and, potentially, to this case — due to its prior history with Trump. FBI and Justice officials have shown open bias against him and have treated him differently than figures like former Secretary of State Hillary Clinton. That record was further exposed recently by another special counsel, John Durham, who found that the Justice Department lacked a basis to launch the Russia-collusion investigation.

Polls show that the majority of Americans harbor serious doubts about the independence and integrity of the FBI. Many voters are skeptical over yet another criminal allegation just before a presidential election.

Smith is under a tight schedule if he wants to charge Trump, though. Since the Justice Department (incorrectly in my view) maintains that a sitting president cannot be indicted, Smith would have to charge and, ideally, try Trump before Election Day. Indeed, the Justice Department strives to avoid any major legal steps that might impact voting near to an election — a period that could stretch back to the late summer of 2024.

What this means is that Trump could face as many as three sets of criminal charges in three different jurisdictions as he campaigns for the presidency. He would likely seek accommodations from courts to delay any trial during the campaign.

Whether or not Trump can delay a trial, much of 2024 will be focused on carceral rather than political issues. Trump has long claimed that Democrats are weaponizing the criminal justice system against him and other Republicans. Bragg has given him the case positive for proving that allegation, especially since Bragg ran for office on his ability to find a criminal charge against Trump.

The question is what happens if any of these efforts succeed.

Det er noget af en tur, kritikken af Trump har taget. Fra at man var bange for at han ville starte en atomkrig til at han var indsat af Putin, til at hans forbrydelse nu er, ikke at have håndteret nogle papirer korrekt nok, som han stoppede Pentagons forsøg på at starte en krig med Iran.
